Terms of Service

Agreement

These terms govern your use of Essence POS, operated by Essence of Sale. By creating an account or using the service you agree to them. If you are agreeing on behalf of a business, you confirm you are authorised to bind that business.

Your account

You must give accurate details when you sign up and keep them current. You are responsible for activity under your account, including anything done by staff accounts you create, and for keeping credentials and device PINs confidential.

The business owner role is set when the business is created and cannot be transferred to another user from within the product. If you need it changed, contact support.

Tell us promptly at support@essenceofsale.com if you believe an account has been used without authorisation.

Free trial

New businesses get a 14-day free trial. No card is required to start it. At the end of the trial you must choose a paid plan to keep using the service.

Plans, billing and price changes

Paid plans are billed in advance, monthly or yearly depending on the plan you select. Plans differ in the number of point-of-sale devices they allow and the features they include; the current plans and prices are shown on our pricing page.

We may change prices. If a change affects your plan we will give you notice before it applies to your next billing period, and you may cancel rather than accept it.

If payment fails, your subscription enters a grace period during which the service continues. If it is still unpaid at the end of that period, access is suspended until payment is made. Your data is retained during suspension.

Cancellation

You can cancel at any time. Cancellation takes effect at the end of the billing period you have already paid for, and we do not pro-rate refunds for partial periods unless the law requires it.

You can export your business data before you cancel. We may delete your data after a reasonable period following cancellation.

Acceptable use

You may not use Essence POS to break the law, to store or process data you have no right to, to attempt to gain unauthorised access to the service or another business’s data, to interfere with or overload the service, or to resell it as your own product without a written agreement with us.

We may suspend an account that is being used in breach of this section.

Your data and ours

Your business data remains yours. You grant us the permission needed to host and process it in order to provide the service, as described in our Privacy Policy.

The Essence POS software, brand and content remain ours. These terms do not transfer any ownership in them to you.

Tax and regulatory compliance

Essence POS lets you configure tax rates, record the tax charged on sales, and print fiscal details on receipts. You remain responsible for meeting the tax, invoicing, fiscalisation and record-keeping obligations that apply to your business in your jurisdiction, and for confirming that your configuration reflects them.

Availability

The cashier app is built to keep working offline and to sync when a connection returns. Server-dependent features, including the admin dashboard, require connectivity.

We aim to keep the service available and to give notice of planned maintenance, but we do not promise uninterrupted service and we may change or discontinue features. If we discontinue something you rely on materially, we will give reasonable notice.

Third-party services

Payment gateways you connect are operated by third parties under their own terms, using your business’s own merchant credentials. We are not responsible for their acts, their fees, or their availability.

Liability

The service is provided as is. To the extent the law allows, we exclude implied warranties, and we are not liable for indirect or consequential loss, or for lost profits, revenue or data.

Where liability cannot be excluded, our total liability to you in any 12-month period is limited to the amount you paid us for the service in that period.

Nothing in these terms limits liability that cannot lawfully be limited.

Changes to these terms

We may update these terms. We will update the date at the top of this page and, where a change is material, notify account holders. Continuing to use the service after a change takes effect means you accept it.
